Background
In the vast and complex panorama of food safety, a crucial role is played by the legislation relating to Materials and Objects in Contact with Food (FCMs). The legislation on Materials and Objects in Contact with Food (MOCA) is a very complex set of laws of different origins which, as a whole, aim to guarantee consumer safety.
In Europe, the basis of the FCMs legislation is constituted by a set of European regulations including, in particular, Regulation (EC) No. 1935/2004 (Framework Regulation) which establishes the general requirements and Regulation (EC) No. 2023/2006 (Good Manufacturing Practices – GMP) which outlines the specific requirements for quality management systems that must be applied in the production of materials or objects in contact.
Europe has also established Specific Measures for some families of materials, such as Regulation 10/2011 on plastics.
The national laws of the various European countries, due to only partial European harmonization, maintain an important role, especially for materials not fully covered by specific EU laws, with the foreseeable differences that exist between the legislation of the different countries. For example, in Italy the Ministerial Decree (D.M.) 21/03/1973 and subsequent amendments is still valid.
In some cases, even non-European legislation may need to be considered. For example, the legislation in force in the USA is widely used for some types of materials.
Finally, the regulatory framework is completed by guidelines that, although not binding, have a reputation that necessarily needs to be taken into consideration. Legislative compliance is achieved through the consistent and synergic use and application of all these different sources. For this reason, it is important to have complete knowledge and understanding of all applicable legislation.
Objective
The primary objective is to provide a thorough understanding of the national and European regulatory framework for FCMs. At the same time, it aims to provide a practical approach necessary for a compliant, but also sustainable, management of contact materials.
Course program
The training course on Food Contact Materials FCMs includes the following topics:
- Definition of FCMs.
- Risks associated with FCMs.
- Contaminants for the various types of materials.
- Dual use additives, NIAS, MOSH and MOHA.
- General requirements according to Regulation (EC) No. 1935/2004.
- Specific measures and Regulation (EU) No. 10/2011.
- Migration limits and migration tests and simulants.
- Declarations of conformity for food contact and supporting documentation.
- Traceability of FCMs.
- Good manufacturing practices according to Regulation (EC) No. 2023/2006.
- Application of good practices in the case of machinery and plant construction.
- Specific obligations according to Italian law (Ministerial Decree 21/03/1973 and subsequent amendments).
- Mutual recognition.
- Applicable strategies in the absence of specific legal obligations for certain materials.
- Sanctioning Legislative Decree 29/2017, liability and sanctions.
- Adoption of the legislation on food contact in the pharmaceutical sector.
Recipients
The course is primarily aimed at manufacturers of machinery and systems for the food sector and the entire production chain, including companies that produce basic components, perform mechanical processing or treatments, or assembly operations.
The course particularly addresses the topic of good manufacturing practices specifically in the case of the production of machinery and systems as indicated by the competent bodies.
It is also aimed at users of such systems and therefore at food companies. This training course on FCMs may also be of interest to those operating in the cosmetic and pharmaceutical sectors and other sectors in which the product may pose risks to the consumer similar to the typical risks of the food sector, such as the tobacco sector.
As regards equipment manufacturers, the course is suitable for all technical personnel responsible for design and key figures relating to manufacturing and the workshop. It is also recommended for managers of other technical and organizational functions such as sales, customer technical assistance and purchasing.
As regards food companies, this course is particularly suitable for managers of technical functions, such as production managers or maintenance managers. It is also recommended for all technicians in the engineering and quality assurance department.
It is also aimed at other figures operating in the food sector, such as suppliers of sanitization products, lubricants or filtration or purification systems.
Course duration
The MOCA course lasts one day, from 9am to 5pm.
Final exam and certificate
Participants who pass the final exam with a score of at least 80% correct answers will receive the «Certificate of Successful Completion».
How the course is conducted
Public sessions are organized or it is possible to request private sessions dedicated to individual companies.
